Participants who fails to comply with all applicable Terms or Participation Agreement, at any time, may be prohibited from current or future participation.
- Participation is open to all Cherokee Nation citizen artists and performers, with preference given to Cherokee National Treasures.
- Participants must be 18 years or older to use Online Resources. Documentation of tribal citizenship/membership must accompany the registration.
- Applications and qualifying shows will be subject for approval.
- Participants must provide accurate information about themselves. It’s prohibited to use false information or impersonate another person or company through an account.
- Participants must choose an appropriate name. Participants may not use language that is offensive, vulgar, infringes someone’s intellectual property rights, or otherwise violates the Terms.
- Participants are responsible for their account and are solely responsible for any activity on their account, so it’s important to keep their account password secure. Accounts are not transferable.
- These Terms do not create any agency, partnership, joint venture, employment, or franchisee relationship between Participants and CED.
- Participants must agree for Cherokee Nation to list or promote their market success in reference to the Cherokee Artist Recovery Act.
- Participants grant a limited, non-exclusive, non-assignable, non-transferable license to CED for the purpose of allowing CED to make images of the artwork by any means, techniques or, media whatsoever to use, re-use, reproduce, display, publish, and re-publish the same in whole or in part, individually or in conjunction with other images, in any medium, now known or hereafter devised for the sole purposes of using the images to conduct, advertise or market Services and maintaining and updating CED’s Service records and files. Images shall not be reproduced without written permission from the copyright owner.
- Any dispute shall be subject exclusively to the laws and jurisdiction of the Cherokee Nation, with venue residing solely in the courts of the Cherokee Nation. Nothing in the terms and conditions, accompanying rules, or any other document or expression shall be construed to waive the sovereign immunity of the Cherokee Nation or any of its entities.
